Dear Sir: The undersigned as Attorney (see designations and authorizations attached) for Respondents (Annunzio For People Committee, Congressman Frank Annunzio, Philip Rosenstrock), hereby requests an extension of thirty (30) days to respond to the Commission's Notice (dated October 2, 1990) of Receipt of a Complaint filed by the National Republican Congressional Committee alleging that Respondents have violated the Federal Election Campaign Act of 1971, as amended. In support of this Request, following:

The Treasurer of the Annunzio For People Committee, Philip Rosenstrock, is currently away, hopefully enjoying a much needed respite from the demands of a rigorous campaign. He will not return until October 22, 1990. His absence makes difficult the obtaining of factual and/or legal materials relevant to the Commission's analysis of this matter.

Other staff personnel of the Committee are intensely engaged in the preparation of required current F.E.C. reports (quarterly report 7/l/90 - 9/30/90, pre-election report - 10/1/90 - 10/17/90), as well as coping with the regular demands of campaign funding and expenditure in the three week period immediately preceding elections.

3.

Respondents' belief is that the factual allegations made in the complaint are insignificant and that the allegations made on information and belief were made solely for the purpose (as was the entire complaint) of creating some reference for misleading headlines intended solely for political purposes. An extension of thirty days in responding to the Commission's Notice will not have any effect on the Commission's analysis of this matter, or upon its (onc fus ion.

Philip Rosenstrock, Treasurer of the Committee, has on behalf of the Committee responded to a routine inquiry (dated September 25, 1990) from the Reports Analysis Division of the Commission concerning the same factual allegations as are found in the complaint. (Refer to Ms. Emily Leonard, Reports Analyst.) The Committee has, as well, filed an Amended Quarterly F.E.C. report for the period 4/1/90 - 6/30/90 containing all the information listed as not available on the original quarterly report.

RWESPONSE TO COMPLAINT MUR 3132

This response is directed to the complaint filed by the National Republican Congressional Commuittee with the Federal Election Commnission alleging violations of the Federal Election Campaign Act of 1971, as amended, by the Annunzio For People Committee, Congressman Frank Annunzio, and Philip Rosenstrock, Treasurer of the Annunzio F,,r People Committs, all referred to in the complaint as Respondents. The allegation in the complaint is set forth as follows: Respondents have violated federal election law by failing to provide, in their July 15th, 1990 Quarterly Report, the names of employers for certain contributors. FACTS

The Annunzio For People Committee timely filed its July 15, 1990 Quarterly Report covering activity for the period April 1, 1990 to June 30, 1990. (Exhibit A)

12, and 14 of the schedule of itemized Pages 5, 6, 7, 8, 10, 11, receipts [11 (a)(i0J of said report contained the names of twenty individuals who had cumulatively through June 30, 1990 exceeded the threshold amount of $200.00 in contributions to the Annunzio For

People Committee, which then made it necessary to set forth in the Quarterly Report not only the itemization of said individuals, but their occupations and employers, as well. 3. The

dividuals was not available to the Coimmittee at the time of the original of the July 15, 1990 Quarterly Report. 4.

These twenty contributors had originally made contributions during the quarterly reporting period ended March 31, 1990. None of the twenty had made contributions in excess of $200.00 at that time. Thus, information as to occupations and employers was not required. These same individuals again mAade contributions to the Committee during the quarterly reporting period ended June 30, 1990. Again, none of these individual contributions exceeded $200.00; thus, the need for information as to occupation and employer was not immediately apparent. (The Committee uses a hand recording system for receipts. At the time of preparing the Quarterly Report for filing, the information from the hand recorded system is computerized.) The Commnittee in preparation of its July 15th Quarterly Report, in accordance with its normal procedures, computerized the information for the period April 1, 1990 through June 30, 1990, and it was then that the computer program aggregated the contributions from these twenty individuals indicating that they

had exceeded, with their second contribution, the $200.00 threshold. Thus, the need for information as to occupation and employer was Indicated. It was only on the last day for filing (mailing) the July 15th Quarterly Report that the Committee became aware of the need for this Information. The Report was completed itemizing these individuals, as they had exceeded the $200.00 threshold. clearly Indicating the additional information as to occupations and employers was being sought. 5.

The Commnittee, as soon as possible, July 23, 1990, sdia tion letters (see Exhibit B - 1 through 20) to the cr.ii)utors requesting the required information.

On or about September 28. 1990, Mr. Rosenstrock, Treasurer of the Annunzico For People Committee received a communication (dated September 25, 1990) from the Federal Election Commuission, Reports Analysis Division, Report Analyst Emily Leonard (Exhibit C), referring to a preliminary review of the Committee's July 15, 1990 Quarterly Report, specifically requesting the supplying of the information with reference to the twenty contributors appearing in The Conimunicathe itemized schedule of the July 15, 1990 Report. tion further required a written response or an amendment to the original report, the latter to be filed with the Clerk of the House of Representatives. The response or amended report to be filed within fifteen days of the date of the commnunication (September 25, 1990).

On or about October 3, 1990, the Comuittee addressed a "Second Request" to those of the original twenty contributors from whom it had not had a response to its first request (Exhibit D through 14). Six of the contributors had responded. (Exhihit E I through 6) -1

On or about October 4, 1990, Mr. Rosenstrock, Treasurer of the Annunzio For People Committee, and Congressman Frank Annunzio, each, received a notice from the Federal Election Commission that a comnplaint had been filed by the National Republican Congressional Committee and enclosing a copy of that complaint. The notice also indicated that the Federal Election Commission in accordance with its own operating procedure designated the matter as a "Matter Under Review" and assigned the number 3132 (Exhibit F).

On or about October 9, 1990, the Committee filed its response (Exhibit G), as required, to the inquiry from the Reports Analysis Division of the Federal Election Commission setting forth that: A.

It had filed with the Clerk of the House of Representatives an amended July 15, 1990 Quarterly Report setting forth the information which had initiated the inquiry. A copy of the amended report was also submitted to the Reports Analysis Division as part of the response. (Exhibit H)

B.

It qualified the information given in the response to the inquiry as to the reliability of its source.

ARGUMENT Application of the Law to the facts as set forth clearly indicates compliance by all Respondents with the statutory requirements: A. At least one effort per solicitation had been made to obtain the required information (requests of July 23, 1990). B. As the facts clearly set forth, there was clear, overwhelming compliance with the "best efforts" requirement of the statute. C. As later events clearly show, the complaint was filed for political purposes, having no other purpose (since the Reports Analysis Division had already initiated an inquiry for the information) than to provide the basis for distorted campaign statemnts, both written and oral. The Commission should be aware that the following phrase was used in a radio comearcial, paid for by the Republican Candidate for Congress from the 11th District, Illinois, which was aired in the Chicago metropolitan area on Friday, November 2, 1990: "Frank Annunzio is under investigation lated federal election campaign laws."

DESCRIPTrIO OF PRELImIARY PROCEDURES FOR PROCESSING COMPLAINTS FrLED WITH THE FEDERAL ELECTION COIlISSION

Complaints filed with the Federal Election Commission shall be referred to the Enforcement Division General Counsel, where they are assigned of the Office of the a MUR (Matter Under Review) number and assigned to a staff member. Within five days of receipt of a complaint, the Commission shall notify, in writing, the respondent listed in the complaint that the complaint has been filed and shall include a copy of the complaint. Simultaneously, with such notification the complainant shall be notified that the complaint has been received and will be acted upon. The respondent(s) shall then have 15 days to demonstrate, in writing, that no action should be taken against him/her in response to the complaint.

.

At the end of the 15 days, the shall report to the Commission makingOffice of the General Counsel upon a preliminary legal and factual a recommendation(s) based analysis and any submission made by the respondent(s). of the complaint A copy of respondent's submission shall be attached to the Office of the General Counsel's report and forwarded to the Commission. This initial report shall recommend either: (a) that the Commission find reason to believe that the complaint violation of the Federal Election Campaign 3ets forth a possible Act of 1971, as amended, (hereinafter "the Act"); or rb) that the Commission fnd no reason to believe that the complaint sets forth a possible violation of the Act and, accordingly, that the Commission close the file in the matter. Sf, by an affirmative of four Commissioners, Commission decides that it vote has reason to believe that a the person has committed or is about to commit 3 violaton of the Act, the Office of the General Counsel shall open an :nvestigation into the matter. During the investigation, the CoMmission shall have the power to subpoena documents, to subpoena individuals to appear for deposition, and to order interrogatories. The respondent(s) written answers to may be contacted more than once by the Commission during its investigation. If, during this period of the indicate a desire to enter into investigation, conciliation, the General Counsel may recommend the Commission conciliation prior to a findingthat of probable cause violation has been committed. Conciliation is an

If the investigation warrants, and no conciliation agreement is entered into prior to a probable cause to believe finding, the General Counsel must notify the respondent(s) of his/her intent to recommend that the Couazmission proceed to a vote on probable cause to believe that a violation of the Act has been commhitted or is about to be committed. Included with the notification to the respondent(s) shall be a brief setting forth the position of the General Counsel on the legal and factual issues of the case. Within 15 days of receipt of such brief, the respondent(s) may submit a brief stating their position on the issues. Both briefs will then be filed with the Commuission Secretary and will be considered by the Commission. Thereafter, if the Commission determines by an affirmative vote of four Commissioners, that there is probable cause to believe that a violation of the Act has been committed or is about to be committed, conciliation must be undertaken for a period of at least 30 days but not more than 90 days. If the Commission is unable to correct or prevent any violation through conciliation the Office of the General Counsel may recommend that the Commission file a civil suit against the respondent(s) to enforce the Act. Thereafter, the Commission may, upon the affirmative vote of four Commissioners, institute civil action for relief in the United States District Court. See 2 U.S.C.

Please note that pages 5, 6, 7, 8, 10, 11, 12, and 14 of Schedule of itemized receipts [line 1l(a)(i), which in the original report indicated an absence of information (occupation and employer) on certain contributors appearing on those pages, has been amended to show that information.

we draw your attention to the following qualification; of

the twenty original names lacking the information, we have received responses to our inquiries (see copies attached) from only six of the contributors (see copies attached). In response to your letter of February 21, 1991, and pursuant to 11 C.F.R., Sec. 111.18(d) the undersigned, attorney of record for the Respondents, Annunzio For People Comnittee and Philip Rosenstrock, hereinafter the "Committee", named in MUR 3132, respectfully requests on their behalf "pre-probable cause conciliation". The Committee denies there have been any violations of 2 U.S.C. Section 434(b)(3)(A), The Federal Election Campaign Act of 1971 as amended, hereinafter the "FECA". The request for "pre-probable cause" conciliation is prompted by a desire on the part of the Comittee to keep to a minimum the time and efforts and the related costs thereof which would be necessary to clearly establish with the Comission, and if necessary with the courts, the absence of any violation of the "Act". In further response to the allegations of MUR 3132 and to indicate the validity of their assertions, the Committee takes the liberty of addressing the issues raised in the Commission's "FACTUAL AND LEGAL ANALYSIS" attached to its letter of February 21, 1991, in order to present supplementary factual information, the absence of which led the Commission to raise questions which, in turn, led to an unwarranted conclusion of "reason to believe". The issue before the Commission, simply stated, is whether the Committee used its "best efforts" to timely obtain supplemental information on 20 contributors who made multiple contributions, the second of which triggered the employer/occupation reporting requirement. Before proceeding to the supplementary factual information, the Commission may find a simple chronology useful in understanding the sequence and the timing of events.

The Conmmittee complied with the requirements of the "best efforts" test under 2 U.S.C. 432 Mi and 11 C.F.R. 102.9(d) by sending a letter to the 20 contributors in question on July 23rd, fully two months prior to the inquiry by the staff correspondent of the National Journal, the RAD request, and the filing of the complaint.

2.The names and addresses of the 20 contributors in question were always available for the purposes of the FECA, beginning with the 1st quarterly report. There has never been any intention to hide from the Commission or the public the identities or any other information in Lhe possession of the Committee regarding the 20 contributors in question. 3.

In accordance with the philosophy of the Federal Election Campaign Act the information was available to the public as a result of the response to the routine inquiry of the RAD on or about October 3, 1990, well before the day of election, November 6, 1990. This, the Committee believes, will compare very favorably with other candidates' principal campaign committee reports on file with the Commission, and in any case ensured disclosure of required contributor information well prior to the election.

4. The Annunzio For People Commnittee during the election cycle involved '3raised some $800,000 in contributions. The complaint and the Commnission's inquiry involve the contributions of some 20 contributors for a total of $8,000.00 [20x times ($200 + $200)], an amount relatively insignificant in the application of the "best efforts" rule to the Committee's compliance. 5.
