Terms and Conditions Governing The American Express – “Win your dream car with just RM100” 2 Grand Prizes : ONE (1) unit of Mini Cooper S Paceman & ONE (1) unit of Mini Cooper S Coupe plus ONE HUNDRED TWENTY THREE (123) Daily Prizes of Nikon D5200 camera (for all new & existing American Express Cards issued by Maybank and Maybank Islamic) Eligibility: 1.

Definition: In these Terms and Conditions, unless the context otherwise requires or unless expressly stated herein to the contrary, the following expressions shall have the following meanings:1.1

“Maybank” refers to Malayan Banking Berhad (3813-K), a company incorporated in Malaysia and having its registered office at 14th Floor, Menara Maybank, 100, Jalan Tun Perak, 50050 Kuala Lumpur.

1.2

“Maybank Islamic” refers to Maybank Islamic Berhad (787435-M), a company incorporated in Malaysia and having its registered office at 14 th Floor, Menara Maybank, 100, Jalan Tun Perak, 50050 Kuala Lumpur.

1.3

“Campaign” refers to “Win your dream car with just RM100” organized by Maybank and Maybank Islamic.

1.4

“Cardmembers” refers to all Principal and Supplementary American Express Charge & Credit Cardmembers whose cards are issued by Maybank and Maybank Islamic.

1.5

“Campaign Period” refers to the period during which the Campaign will be held which commences from 4 July 2013 to 3 November 2013 (both dates inclusive).

1.6

“New” Cardmember herein refers to:

a) Non-existing Principal Maybankard 2 American Express Credit or Charge Cardmember b) Maybank American Express Credit or Charge Card cancelled for more than SIX (6) months. For the avoidance of any doubt, existing Maybank Principal Credit Card (not including American Express Credit and/or Charge Card) or Debit Cardmember upon card approval will be classified as “New” Cardmembers. 1.7

“Successful card approval” refers to the card applications that has been approved by the Bank and a card has been issued to the Cardmember. The Bank reserves the right at its absolute discretion to approve or reject any application.

1.8

“Qualified Transactions” refer to posted transactions which are made either by local or overseas retail, EzyPay as well as online payment must be made using the Maybank American Express Cards issued by Maybank and Maybank Islamic. Qualified Transactions do not include outstanding balance, cash advance, finance charges, late charges, interest payment, autopay charges, Balance Transfer, government service tax, annual card membership fees, reversals, existing EzyPay & EzyPay Plus made before the Campaign Period and EzyCash.

1.9

“Campaign Prizes” refer to the two (2) Grand Prizes which consists of one (1) unit of Mini Cooper S Paceman and one (1) unit of Mini Cooper S Coupe plus one hundred twenty three (123) Daily Prizes of Nikon D5200 camera will be given away during the entire campaign duration.

2.

The Campaign is open to all new and existing eligible Maybank American Express Credit and/or Charge Card issued by Maybank and Maybank Islamic including Principal and Supplementary cards, excluding corporate cards.

3.

The following person(s) and/or card type shall not be eligible to participate in the Campaign: a.

Cardmember who has committed or is suspected of committing any fraudulent, wrongful or suspicious acts or transactions in relation to any of his/her Credit and/or Charge Cards issued by Maybank and Maybank Islamic or is in breach of any of the terms and conditions governing the use of Maybank’s and Maybank Islamic’s products and/or services or is insolvent or an undischarged bankrupt or is subjected to any bankruptcy or insolvency proceedings; or

b.

Cardmember whose facilities granted by Maybank and Maybank Islamic, or account(s) held or maintained with Maybank and Maybank Islamic is or becomes delinquent or no longer of good credit standing; or

c.

Cardmember whose Credit and/or Charge Card(s) is/are involved or suspected of being involved in any fraudulent, wrongful or suspicious activity, or whose Credit and/or Charge Cards have been blocked, suspended, cancelled or terminated for any reasons whatsoever; or

d.

American Express Corporate, Business, Purchasing Cardmembers other Cards apart from American Express Consumer Cards; or

e.

Cardmembers who are or become insane, deceased or insolvent commencement or at any time during the Campaign Period; or

and

all

American Express Charge or Credit Card(s) not issued by Maybank and Maybank Islamic in Malaysia.

g.

Employees of Maybank and Maybank Islamic and their respective immediate family members.

h.

Employees of Maybank’s and Maybank Islamic’s partners including advertising and promotion agencies and any other persons involved in organizing, promoting and/or conducting this Campaign.

Notwithstanding the above, Maybank and Maybank Islamic shall have the discretion in deciding the eligibility criteria for participation in the Campaign and such criteria may be varied, amended or changed from with 21 days prior notice.

The Campaign mechanics: 1. Existing Cardmembers : Five (5) entries for overseas spent, one (1) entry for other spent Existing Principal or Supplementary Maybank American Express Cardmembers are entitled to earn entry(ies) as below : i) Every interval of RM100 (non-cumulative) spent at local retails, EzyPay and online transaction in a single transaction with Maybank American Express Card will be automatically entitled to one (1) entry. ii) Every interval of RM100 (non-cumulative) spent at overseas retails in a single transaction with Maybank American Express Card will be entitled to five (5) entries. For overseas transactions, the number of campaign entries will be based on the amount transacted that are converted to Ringgit Malaysia at the rate determined by the Bank and shall be based on the transaction captured and recorded by the Bank Credit Card System. 2. New Cardmembers : Five (5) entries throughout Campaign Period For New Cardmembers to be eligible and qualify for five (5) campaign entries he/she must fulfill the following criteria: i) New approved application for American Express Credit and Charge Cards during Campaign Period. ii) To spend any transaction of minimum RM100 either at local retails, EzyPay, online as well as overseas retails with Maybank American Express Card during the Campaign Period.

3. The number of entries entitlement of the Supplementary Cardmembers will be accumulated to the Principal Cardmember’s account. 4. Entry is automatic subject to the Cardmembers fulfilling the above-mentioned criteria. No Short Message Service (SMS), pre-registration or entry forms are required. 5. The following transactions or categories shall not be entitled as Campaign entries: Transactions for Maybank EzyCash, existing Maybank EzyPay and EzyPay Plus made before the Campaign Period, Cash Treats, cash advance, auto pay charges, Balance Transfer, refunded, disputed, unauthorized or fraudulent retail transactions; Payment for transactions, outstanding balance, reversals, payment of annual card membership fees, interest payments, late charges, finance charges, government service tax, charges for cash withdrawals; Any other form of service or miscellaneous fees.

PRIZES 1. Cardmembers are only entitled to be a winner once for each category of prizes throughout the Campaign Period. Cardmembers can win once (1 time) for the Daily Prize which is one (1) unit of Nikon D5200 camera and once (1 time) for the Grand Prize of either one (1) unit of Mini Cooper S Paceman or one (1) unit of Mini Cooper S Coupe.

a DAILY PRIZES: One hundred and twenty three (123) units of Nikon D5200 camera i) One hundred and twenty three (123) Nikon D5200 camera will be given away under this Campaign from 4 Jul 2013 to 3 Nov 2013, one (1) Nikon D5200 camera will be given away each day (“Daily Prize”). ii) The Daily Prize winners will be announced on monthly basis within approximately eight (8) weeks after the transaction date and the Prizes will be delivered within eight (8) weeks from the transaction date as per the schedule below : Tracking Month

A Cardmember is only entitled to win one (1) Daily Prize throughout the Campaign Period. 4. If the Daily Prize remains unclaimed or returned after two (2) attempts of having it delivered to the winning Cardmember, the Daily Prize will be deemed forfeited.

b GRAND PRIZES : One (1) unit of Mini Cooper S Paceman and one (1) unit of Mini Cooper S Coupe 1. The Grand Prizes of one (1) unit of brand new Mini Cooper S Paceman and one (1) unit of Mini Cooper S Coupe does not include road tax, car registration and insurance coverage. The Winners shall be responsible for any additional costs, duties, taxes and/or other incidental expenses, which may be incurred as a result of and/or related to Winner’s acceptance of the Grand Prize. The actual colour and car specification of the Grand Prizes may vary from the picture shown in all communication medium distributed for this Campaign. Winners are required to register the Grand Prizes with the Jabatan Pengangkutan Jalan (JPJ) latest by 31 December 2013 to be entitled for the Grand Prizes. 2. The announcement of the results for the Grand Prizes Winners will be made within eight 8 weeks after the Campaign ends. Tracking Month

SELECTION OF WINNERS 1

Criteria to qualify as a Winner are as follows : a) Eligibility to participate the Campaign; b) Shortlisting based on lucky draw basis using a randomizer program; and c) Ability to correctly answer a question posed to the selected Cardmember

2 Upon shortlisting of the Cardmember, the said Cardmember shall be contacted by Maybank’s and Maybank Islamic’s representative by telephone at any time during office hours (Mondays to Thursdays from 8:45am to 5:45pm, Fridays 8:45am to 4:45pm) to answer one (1) question. 3

The shortlisted Cardmember is required to answer one (1) question correctly in order to be considered a Winner. If the shortlisted Cardmember fails to answer the question correctly within two (2) attempts, he/she will not be entitled for the prize and the next selected shortlisted Cardmember would be contacted to answer the question.

4 In the event Maybank’s and Maybank Islamic ‘s representative is unable to contact the selected Cardmember by telephone for reasons including, but not limited to, no reply, number not in use, no connection or voice message, Maybank and Maybank Islamic representative may at their discretion make a second attempt to contact the Cardmember. If the second attempt is unsuccessful, the selected Cardmember shall be disqualified from this Campaign and shall not be entitled to enter into this Campaign and for any prize.

5 A Maximum of two (2) attempts shall be made to contact the selected Cardmember via phone. The telephone calls made to the Cardmembers will be based on the telephone numbers supplied by by the Cardmembers to Maybank and Maybank Islamic. It shall be the Cardmembers responsibility to ensure that their phone numbers provided are current and accurate. 6 Maybank and Maybank Islamic has the sole discretion to determine the appointed date and time to to make the telephone calls to the selected Cardmembers. Maybank and Maybank Islamic shall not be held responsible for calls made to selected Cardmembers which are (i) not completed or disconnected due to any reasons whatsoever; or (ii) not answered or not able to proceed due to the unavailability of selected Cardmembers at the appointed date and time and/or due to any other reasons whatsoever. 7 All question and answer sessions will be judged and decided by Maybank and Maybank Islamic and the decision of Maybank and Maybank Islamic shall be final and no enquiries and correspondences will be entertained. 8 Cardmembers who successfully answer the question correctly will be announced as the Winner. The Winner shall be entitled to the Daily Prize which shall be delivered to the respective Winners as per the address confirmed during the call. 9 The Prizes will be forfeited if the Cardmember’s Card(s) is/are terminated by Maybank and Maybank Islamic for any reason whatsoever, and/or if it is voluntarily terminated by the Cardmember during Campaign Period. 10 Winners are required to attend the Prize presentation ceremony and/or any other publicity programs at their own costs and expenses at the date/time and venue stipulated by Maybank and Maybank Islamic for the purposes of receiving the Prizes, at their own costs and expenses. 11 The prizes are manufactured or produced by third parties (“Manufacturers”). To the fullest extent permitted by law, Maybank and Maybank Islamic and/or any of its representatives shall not be liable and expressly excludes and disclaims any representation, warranties, or endorsements, expressed or implied, written or oral, including but not limited to, any warranty of quality, merchantability of fitness for a particular purpose in respect of the Prizes. Maybank and Maybank Islamic and/or its representatives, shall not be responsible nor liable in any manner whatsoever for any deficiency or inadequacy of services rendered by any third party or for any loss whatsoever in the course of availing the Prizes. 12 All Prizes are given on an “As Is” basis. Prizes are not transferable or exchangeable for cash, in part or in full. Maybank and Maybank Islamic reserves the right to substitute the Prize with that of similar value at any time with twenty one (21) days notice to the Winners via maybank2u.com or any other channel(s) that Maybank and Maybank Islamic may deem as appropriate.

13 Cardmembers also agree and consent to such details including without limitation personal data or information being collected, processed and used by Maybank and Maybank Islamic for; a) The purposes of the Campaign; b) Marketing and promotional activities conducted in such manner as Maybank and Maybank Islamic see fit in any media including but not limited to any form of advertising or publicity media and materials such as audio and/or visual recordings published through newspapers, television networks, radio stations or online and digital media and on the Internet, without further express consent from the Cardmembers. Marketing and promotion activities include without limitation the use and/or publication of any details provided in and/or in connection to the entries, interviews material as well responses and related photographs. In this regard, each Cardmember agrees to co-operate and participate without further express consent and/or payment or consideration, in all reasonable advertising and publicity activities of Maybank and Maybank Islamic relation to the Campaign. c) Other promotional, marketing and publicity notification/information including future promotional, marketing and publicity notification/information from Maybank and Maybank Islamic from time to time.

GENERAL TERMS & CONDITIONS 1

By participating in this Campaign, the Cardmember hereby duly agrees to be bound by the Terms and Conditions herein set forth including any amendments thereto.

Maybank and Maybank Islamic reserves the right to withdraw, cancel, suspend, extend or terminate this Campaign earlier in whole or in part and Maybank and Maybank Islamic reserves the right to vary, supplement, delete, amend or modify any of the Terms and Conditions from time to time by giving at least minimum of twenty one (21) days prior notice thereof and the notice shall be posted through Maybank2u website at www.maybank2u.com or through any other channel or channels that Maybank and Maybank Islamic may deem as appropriate.

By participating in this Campaign, the Cardmember hereby agrees to access the websites at www.maybank2u.com and/or www.americanexpress.com.my on a regular basis to view the Terms and Conditions for this Campaign and shall ensure that they are kept-up-to-date with any changes or variations made to the Terms and Conditions.

In no event shall Maybank and Maybank Islamic nor any of its officers, servants, employees, representatives and/or agents (including without limitation, any third party service providers engaged by Maybank and Maybank Islamic for purposes of the Campaign) be liable to the Cardmembers in this Campaign for any direct, indirect, special or consequential loss or damage (including but not limited to, loss of income, profits or goodwill) arising from or in connection with this Campaign.

To the fullest extent permitted by law, Maybank and Maybank Islamic shall not be responsible and/or liable nor shall it accept any form of liability whatsoever nature and howsoever arising or suffered by Cardmembers resulting directly or indirectly from the Cardmembers participation in the Campaign or otherwise. Furthermore, Maybank and Maybank Islamic shall not be liable for any default of its obligation under the Campaign due to any force majeure event which include but not limited to act of God, war, riot, lockout, industrial action, fire, flood, drought, storm or any event beyond the reasonable control of Maybank and Maybank Islamic.

Maybank and Maybank Islamic reserves the right to forfeit the Daily Prize(s) and/or Grand Prize(s) and disqualify the eligibility in the event there is a reversal of spends entry, cancellation or termination of the Maybank American Express Cards during the Campaign Period and/or failure to comply with any of the Terms and Conditions herein. Maybank and Maybank Islamic reserves the right to disqualify any suspicious transactions at any stage of the Campaign with twenty one (21) days prior notice to the Cardmembers.

The records of transactions maintained by Maybank and Maybank Islamic and the selection of Winners by Maybank and Maybank Islamic shall be final and conclusive. The records of transactions maintained by Maybank, within or outside of Malaysia and the selection of Winners by Maybank shall be final, binding and conclusive. The decision of Maybank is final and no appeal and/or correspondence or claims shall will be entertained.

The Winners shall not be entitled to any cash compensation, benefits or substitution in any form whatsoever in lieu of the prizes. However, Maybank and Maybank Islamic reserves the right to substitute any of the Prizes with that of similar value at any time at its sole and absolute discretion by giving twenty one (21) days prior notice to the Winners.

In the event the Supplementary Cardmember is a winning entry, the entry will accumulate to Principal’s account and the Prize will be awarded to the Principal Cardmember.

10 These Terms and Conditions are in addition and without prejudice to the Maybank and Maybank Islamic’s Credit Card agreement with the Cardmember which regulates the provision of credit card facility by the Maybank and Maybank Islamic to the Cardmember. These Terms and Conditions shall prevail over any provisions or representation contained in any promotional materials (including but not limited to printed posters or leaflets) and advertisements of this Campaign. In the event of any inconsistency between the Terms and Conditions contained herein and the Terms and Conditions governing Banking Account, the Terms and Conditions herein shall prevail for the purpose of this Campaign.

11 These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia and the Cardmember hereby agrees to submit to the exclusive jurisdiction of the Courts of Malaysia.

12 Maybank and Maybank Islamic shall not be liable for any default or delay in respect of the Campaign due to any act of God, war, riot, strike, terrorism, epidemic, lock-out, industrial action, fire, flood, drought, storm, computer glitch, loss of electricity or power for any length of time or any event that is beyond the reasonable control of the Maybank and Maybank Islamic. All Terms and Conditions governing the Bank’s products and services shall, whether repeated herein or not, be deemed incorporated into this Terms and Conditions.
