What is the rate of Contribution? 12% of basic salary and dearness allowance earned by the employee while on duty or on leave or on holidays with salary, but shall exclude all other allowances and perquisites. Equal Contribution also contributed by ALUMS out of which 8.33% (maximum of Rs. 541/-) will goes to Pension Fund managed by Regional Provident Fund Commissioner, Gurgaon

What is the voluntary rate of Provident Fund contribution by the member? What is procedure of enrolment/Changes/discontinuation in VPF. As per the Act, the member has to contribute at the rate of 12% of his basic pay, D.A. & retaining allowance if any. In case the member wants to contribute more than this, voluntarily he can do so at any rate he desires. i.e. up to 88% of basic and D.A. But the employer is not bound to contribute at the enhanced rate. An employee can enter in VPF Scheme at any time during the year. Similarly VPF can be stopped at any time and request for the same can be submitted through regional HR team. Change in rate of contribution is allowed only in March (payroll cycle) every year and an employee can’t change the rate of VPF before completion of one year tenure of contribution in VPF. Please ensure to provide the scan copy of the dully signed filled form to Ms. Neetu Yadav at [email protected] on or before 10th day of month for effecting the enrolment in VPF from current month. Any request received post 10th day of month will be considered in next month. Please submit hard copy of the Form on or before 20th day of the month. For enrolment the “VPF Declaration Form” under tab “ FORMS” is available on web portal of Mynd Solutions. How are contribution deposited – Monthly / Quarterly Every month Company transfers contribution to trust. All amounts received by Trust are invested as per pattern of investment prescribed under Rule 67 of the Income Tax Rules, 1962.

What are the rules for appointment of beneficiary/Nominee 1. Each member shall make in his declaration in Form 2, a nomination conferring of the right to receive the amount that may stand to his credit in the Fund in the event of his death before the amount standing to his credit has become payable, or where the amount has become payable before payment has been made. 2. A member may in his nomination distribute the amount that may stand to his credit in the Fund amongst his nominees at his own discretion. 3. If a member has a family at the time of making a nomination, the nomination shall be in favour of one or more persons belonging to his family. Any nomination made by such member in favour of a person not belonging to his family shall be invalid: [PROVIDED that a fresh nomination shall be made by the member on his marriage and any nomination made before such marriage shall be deemed to be invalid.]

If at the time of making a nomination the member has no family, the nomination may be in favour of any person or persons but if the member subsequently acquires a family, such nomination shall forthwith be deemed to be invalid and the member shall make a fresh nomination in favour of on or more persons belonging to his family. [(4A) Where the nomination is wholly or partly in favour of a minor, the member may, for the purpose of this Scheme, appoint a major person of his family, as defined in clause (g) of Paragraph 2, to be the guardian of the minor nominee in the event of the member predeceasing the nominee and the guardian so appointed: PROVIDED that where there is no major person in the family, the member may, at his discretion, appoint any other person to be a guardian of the minor nominee.] 5. A nomination made under sub-paragraph (1) may at any time be modified by a member after giving a written notice of his intention of doing so in Form [2] annexed hereto. If the nominee predeceases the member, the interest of the nominee shall revert to the member who may make a fresh nomination in respect of such interest. 6. A nomination or its modification shall take effect to the extent that it is valid on the date on which it is received by the Commissioner. 7

What is meant by Family? Family means employees' spouse and children below 25 yrs. of age.

Suppose employee does not have a Family and he/she dies before receiving benefit. Does his/her pension get lost? No, if he/she does not have a family, benefits will be paid to his/her legal heir and in case

of any disputes between claimants then succession certificate from Court will be mandatory. Suppose member has not nominated anyone? In case of unmarried one, the amount will be paid to dependant father or dependant mother as the case may be.

In case of married one, the amount will be paid to his/her spouse and children’s. 10 How many years service is required to be eligible to receive pension? Minimum 10 years eligible service will entitle for pension. 11 What is the declaration of employment At the time of joining employee have to submit Form 11 along-with Form 2 (Nomination Form) duly filled and Signed by him/her, to respective HR department 1. Employee will fill the Form 11 in following manner : a. In point no.(a) fill name & address and date of leaving with previous employer, employee must fill details of last to last employer, if applicable b. In point no. (b) employee will fill the details of last PF office along with date of membership of Pension Fund and PF code allotted by previous employers. c. Employee must fill the details of funds withdrawn/not withdrawn in point no. (c) to (h) 2. It will be signed by Authorised Signatory of the company and kept these form in their custody. They will provide these forms whenever required by consultant or PF Department for inspection. 12 What is the process of PF Transfer from Previous Employer? Member can apply for PF transfer from his/her previous PF Account Number (with previous organization) to his/her new PF account number with present employer. It’s mandatory to submit Form 13 in two original copies where funds of previous employer are managed by PF Trust. 1. Employee can apply the PF transfer through Form No. 13. Serial No. 1 to 8 should be completely filled and form should be signed by the employee. Please note : a) Submission of Form 3A along-with Form 13 is mandatory, if employee had left the previous organization in current FY and funds are lying with any of the RPFC. b) Submission of Form 3A is not mandatory if funds are managed by any of the PF Trust. In this scenario employee need to obtain Form7PS from previous employer. 2. Filled Form will be sent to Ms. Neetu Yadav on under-mentioned address: Alcatel Lucent India Ltd. For confirmation of receipt of Form, please raise your query on web portal of Mynd Solutions after 7days of submission of Form to concerned person 3. Mynd Solutions Pvt. Ltd. Will process the form and submit the same with **concern authority (RPFC/Trust) within 20 days (for new hired within 20 working days from the date of allotment of PF No. which will be allotted after 20 working days of disbursement of first salary) from the date of submission. In case of any discrepancy in application Mynd will inform to employee within 10 working days from the date of receipt of application by them. ** Concern Authority means the RPFC, Gurgaon/Mumbai where Alcatel is currently complying. Submission of transfer Form through our own RPFC is mandatory because before transfer of funds by previous RPFC confirmation of PF Account no. by RPFC, Gurgaon Alcatel is mandatory. In case of transfer of funds from Trust of previous employer we will submit the application directly to Trust. 4. Mynd will provide scan copy of submitted application within 7 working days of to concerned employee. 5. Employee will get auto generated e-mail from helpdesk team on receipt of transfer of funds from RPFC/ Trust and he/she can view the same in PF ledger of current year. 6. Normally RPFC’s are taking 3-4 months time in transfer of funds. In case of nonreceipt of PF transfer within 4 months employee can follow personally with RPFC, Gurgaon/Mumbai with help of submitted copy shared by helpdesk team. 13 What are the Benefits on Leaving/Retirement/death of employee? The member shall be entitled to the under noted benefits 1. If member want to withdraw funds from Trust after leaving the services of the company, he will submit the withdrawal form after 2 months from the DOL. All PF accumulations are taxable in hands of the employee if membership at the time of leaving is less than 5 years. There is no any tax liability in case of transfer of funds to his/her new employer account or if member had completed 5 years membership of the fund. 2. In case of retirement all PF accumulation will be paid to member.There is no tax liability on the same and funds will be paid to member immediately i.e. there is no any cooling period of 2 months. 3. In case of death all funds lying in the account of diseased member will be paid to nominee of the member. There is also no clause of tax liability and cooling period of 2 months.

14 What is the process of PF/EPS withdrawal from Alcatel? Employee can initiate for PF withdrawal only after two months of his/her Date of Leaving. For withdrawal of accumulations under-mentioned Forms are required : a) Withdrawal of Provident Fund : For PF withdrawal from Trust two forms named (i) Trust withdrawal form and (ii) Form-19 along-with duly signed cancelled cheque is required b) Withdrawal of Pension Fund : For withdrawal of pension Form-10C along-with duly signed cancelled cheque is required. Exemption on 2 month lock period: In case of retirement/Female Marriage/Moving out of country. Filled Form will be sent to Ms. Neetu Yadav on under-mentioned address: Alcatel Lucent India Ltd. system (ticket system) within 10 working days from the date of receipt of withdrawal Forms. For remaining correct forms Mynd will process and pay the funds through NEFT/Cheque within 45 working days from the date of receipt of claims. Payment of Pension Fund : EPS (pension) withdrawal application will be submitted with in a month with respective RPFC after the required verification. Similar procedure, as mentioned in above paragraph, will be followed for incorrect applications. Mynd Team will provide scan copy of submitted application to employees. RPFC will directly pay to employees through NEFT. Tentatively 3-4 months are taking by RPFC’s in settlement of pension withdrawals. If any employee had served more than 9.5 years (including service period of previous employer, if pension transfer already effected) then withdrawal is not permissible and benefits of the same will be paid in form of pension on attaining retirement age/ to nominee in case of death. 15 What are the benefits available to employees while in service? The member shall be entitled to the under noted benefits while in service:Member may avail non-refundable loan facility against his/her PF accumulations subject to fulfillment of conditions laid down in the trust rules, for housing loan,repayment of existing housing loan,marriage (self & dependent family members) / /medical treatment (self & family) etc. 16 What happens to the Pension Fund (8.33% (maximum Rs.541/- per month)? RPFC will pay pension to employees in case of retirement and to his/her family in case of death of the employee. Employee may withdraw contributed amount from RPFC if he/she had not completed 10 years of service. 17 And /or how about the sending the annual statement of accounts to each employee by a certain date on a yearly basis. Yearly statements are available on web portal and can be accessed by individual employees through login credentials. In statement reflected on web portal, carry forwards balances of EPS (Pension) are not showing because these funds are managed by the office of RPFC. Further the benefits of the said scheme is purely based on “DEFINED BENEFIT” not on CONTRIBUTION DEFINED” 18 What are the forms required for PF & Pension ? 26 Why the PF contribution does not reflect for past years?

The information on Mynd site is related to current contribution i.e. onwards October 2009. However contribution from July-2008 to September-2009 will be updated on Mynd site under head “PF Transfer-in” once we will receive the Fund from RPFC, Mumbai and also the date of membership will be updated accordingly but the PF no. which is mentioned on our site will continue to be the same for future references. Further for Reliance transition employees web portal will be updated with consolidated amount under head “PF Transferin” once the Funds will get transfer from respective trust i.e. Reliance trust and also the date of PF membership will be updated accordingly. 27 Resolution of queries/ doubts of employees Please raise ticket through web site of Mynd Solutions (http://retirals.myndsolution.com) . If any employees doesn’t have their login credentials then they can write to HRSC India at [email protected]. Mynd will respond on all the queries with in SLA of 3 working days.
