Bank of the West Rewards Program Rules for Credit Card Accounts Definitions 1. a.

“Account” means the eligible Bank of the West Rewards credit card, or any replacement thereof, enrolled in the Bank of the West Rewards Program (“Program”).

b.

“Award(s)” means the rebates, services, merchandise and travel offered to the holder(s) of an Account after you claim the Points you may accrue pursuant to these Rules.

c.

“Bank” means Bank of the West.

d.

“Good Standing” means not closed, cancelled or terminated by either party, over-the-credit-limit, delinquent, or otherwise not available to use for new transactions.

e.

“Rules” means the Bank of the West Rewards Program rules.

f.

“You” or “Your” refers to the holder(s) of an Account.

How Points work 2. As provided in these Rules, Bank accrues one (1) Point for every one ($1) dollar in net qualifying purchases (purchases minus returns/credits) rounded to the nearest whole point on an Account that: (i) you charge with your Bank of the West credit card enrolled in the Program; and (ii) appears on your Account statement during the Program. Points are calculated separately on each transaction by dividing the purchase amount by one and rounding to the nearest whole point. No Points are accrued for purchases when you enter your PIN number, or for finance charges, fees, balance transfers, cash advances, convenience check transactions, foreign transaction currency conversion charges, credit insurance charges, or debt cancellation charges posted to your Account. Any credits, except payments made on the account, will reduce the number of Points available based on the dollar amount of the credit. Bank is not responsible for any delay in a merchant posting of a transaction to your Account.

Claiming Your Points 3. You must claim Points accrued through the Program through the redemption process to exchange the Points for Awards. No other person, including, without limitation, any trustee, administrator, executor or heir, may claim the Points on your behalf. Points can be claimed and used for Awards available in the then current Program. You may select Awards from any level, as long as you have accrued and can claim a sufficient number of Points available in your rewards account. Point requirements assigned to any Award are subject to change from time to time without notice, and Awards may be substituted at any time. Should an Award be discontinued, it may be replaced with an Award of equal or greater value or, if no suitable substitute is available, you will be advised to make an alternate selection. Please refer to the Travel Redemption Rules located on www.bankofthewestrewards.com for applicable rules and fees.

Merchandise Awards 4. Any merchandise Award usually will be delivered by a commercial delivery service or by the U.S. Postal Service within 4-6 weeks of processing your order. We may require verification of your identity and Account prior to processing your order. Shipments cannot be made to a post office box or outside the United States and eligible territories. If you have an APO address, please contact Bank of the West Rewards Award Headquarters at (866) 791‐4106 for details regarding merchandise options and shipments.

Damages to Merchandise 5. Upon receipt of any merchandise Award, you should note any damages or shortages on the delivery receipt before signing to accept delivery from the carrier. A product which is received damaged or defective must be returned to the shipper within thirty (30) days of receipt for replacement. Manufacturer Warranties 6. Applicable manufacturers’ warranties will be included with your Award. Warranty claims must be directed to the manufacturer. BANK AND ITS SERVICE PROVIDERS MAKE NO PRODUCT REPRESENTATIONS, GUARANTEES, OR WARRANTIES, EXPRESS OR IMPLIED IN FACT OR LAW, REGARDING ANY AWARD, INCLUDING BUT NOT LIMITED TO, ITS QUALITY, CONDITION, MERCHANTABLITY OR FITNESS FOR A PARTICULAR PURPOSE, AND DISCLAIM ANY AND ALL LIABILITY AS TO THE CONDITION, QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF PRODUCTS AND/OR SERVICES PROVIDED THROUGH THIS PROGRAM. Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. To the extent those apply to you, some of the provisions set forth in these Rules may not apply.

Points Have No Cash Value 7. Points have no cash value and may not be used to repay other obligations to us or anyone else. You have no property rights or other legal interests in the Points accrued through the Program, and they may not be transferred (including any transfer upon death or as part of a domestic relations matter), assigned, bought, or sold.

Viewing Your Points/Checking Point balance 8. You may view accrued Points subject to adjustment, online at www.bankofthewestrewards.com by logging into your rewards account, or over the phone at (866) 791-4106. If there is any error in your Points as disclosed to you, you must report the discrepancy to us within 30 days of the date of the report.

Closed Accounts; Account Standing 9. If your Account is closed for any reason, you will no longer be able to accrue Points and all accrued Points not claimed and redeemed for that Account will be forfeited. Your Account must be in Good Standing at the time you claim and redeem Points for an Award. Bank reserves the right to suspend your participation in the Program and the accrual of additional Points until the Account is in Good Standing. Upon bringing your Account into Good Standing, your participation in the Program will be reinstituted, but Points previously forfeited or eliminated will not be reinstated.

Printing Errors 10. Despite the Program’s best efforts to ensure accuracy, printing errors occasionally occur. The Program reserves the right to correct such errors at any time even if it affects a pending claim of Points or Award redemption.

Rewards Program Modifications 11. This Program may be modified, suspended or cancelled at any time. These Rules may be added to, deleted from or otherwise amended at any time upon such notice as is required by law. Changes to the Program may include, but are not limited to, modifications which affect Point accrual and the expiration of Points. Only if you have an Account will you be provided with written notice of any material change to the Program and Rules. All notices pertinent to this Program or the Rules may be sent by mail addressed to the last address shown in our records for you or sent to you by email at the email address on file with us. Your continued participation in the Program after the effective date of any notice of change shall constitute your agreement to the Program or Rules as amended. Any notice provided to you hereunder will be deemed received by you no later than the earlier of the date received or within five days from the date it is sent or posted. Contact Bank for details on any current promotions affecting Point accrual or redemption options. Accrued Points may be eliminated due to Rules violations. This Program is void where prohibited or restricted by law. You are responsible for any applicable federal, state or local taxes.

Liability 12. You release and agree to hold Bank, its officers, employees, agents and service providers harmless in connection with any injuries and damages of every kind and nature arising in connection with or as a result of your claiming and redeeming Points and with your receipt of and use of an Award. You waive and release any and all rights, demands, losses, liabilities, claims and causes of action whatsoever that you may now or hereafter be entitled to assert, including, but not limited to, any death, injury, loss of enjoyment or other harm or loss of any nature whatsoever caused by, contributed to, or arising out of any Award, its acceptance or use. You further agree to hold Bank and any of its service providers harmless if an Award vendor or provider files for bankruptcy, or otherwise goes out of business, after you have redeemed your Points for an Award from the vendor or provider but before you are able to receive or use the Award. Program Restrictions 13. Certain restrictions may apply to travel certificates, tickets and documents. Travel and other certificates are not exchangeable, refundable, transferable or redeemable for cash. All travel certificates, tickets and documents will be mailed first class U.S. Mail and will not be replaceable in the event of loss, destruction or theft. Your award will usually be delivered within 4-6 weeks of processing your order. You may request travel certificates, tickets and documents to be delivered by overnight carrier and agree to pay the associated additional delivery fees by card. Unless otherwise stated, you are responsible for federally imposed airline security fees as well as any surcharges or additional fees as may be imposed by the airlines or local aviation authority and must pay them by card at the time of the reservation booking. Please refer to the Travel Redemption Rules located on www.bankofthewestrewards.com for applicable rules and fees.

About These Rules 14. The Bank shall resolve all questions of what constitutes an eligible charge. All Program Rule determinations by the Bank are final. By using the card enrolled in this Program or otherwise accruing Points, you agree these Program Rules, as amended from time to time, will govern the Bank of the West Rewards Program. Bank of the West Rewards Program Rules for Debit Card Accounts Definitions 1.

a. “Account” means the eligible Bank of the West Debit Card, or any replacement thereof, enrolled in the Bank of the West Rewards Program (“Program”). b. “Award(s)” means the rebates, services, merchandise and travel offered to the holder(s) of an Account after you claim the Points you may accrue pursuant to these Rules. c. “Bank” means Bank of the West. d. “Deposit Account” means the deposit account to which an Account is linked. e. “Good Standing” means not closed, cancelled or terminated by either party, overdrawn, delinquent, or otherwise not available to use for new transactions. f. “Rules” means the Bank of the West Rewards Program rules. g. “You” or “Your” refers to the holder(s) of an Account.

How Points work 2. As provided in these Rules, Bank accrues ten (10) Points for every net qualifying purchase (purchase transactions minus returns/credit transactions) on an Account that: (i) you charge with your Bank of the West Debit Card enrolled in the Program; and (ii) appears on your Deposit Account statement during the Program. Qualifying purchases include purchases made with a PIN or purchases you sign for, Internet, phone or mail-order purchases, small dollar purchases that don’t require a signature, and bill payments. Any returned purchase will reduce the number of Points available by ten (10) Points. No Points are accrued for fees, cash transactions, or foreign transaction currency conversion charges. Bank is not responsible for any delay in a merchant posting of a transaction to your Account. The Program constitutes a consumer retention program operated by Bank to provide consumers with Points that upon being claimed are redeemable for or towards goods or services or other monetary value as a reward for purchases made.

Annual Fee 3. Deposit Accounts with an Account(s) enrolled in the Program will be charged a Debit Rewards Annual Membership Fee of $15, unless the enrolled Account(s) were enrolled in the Program prior to October 15, 2012 or the Deposit Account, Account, or bundle type includes enrollment in the Program. The Debit Rewards Annual Membership Fee will be charged annually on or near the same date. Consult your Deposit Account disclosures for any applicable fee waiver information.

Claiming Your Points 4. You must claim Points accrued through the Program through the redemption process in order to exchange the Points for Awards. Travel Program Redemption Rules Please review the complete rules and restrictions listed below. Your use of this Site ("Site") for redemption or purchase of travel components constitutes your agreement to all such terms, conditions, and notices. In addition to these Travel Program Redemption Rules, please see the FAQs for additional award and program information. Please read all information carefully before making any payment or redemptions.

General Terms and Conditions • • •



The reward portion of your transaction will be paid for by the reward program's account. If applicable, any fees or redemption-associated charges will appear on monthly card statements as "Trip Charges." Charges may show from the airline, hotel chain, car rental company, activity provider, and/or travel insurance agency on your credit or debit card statement. Remaining balances not charged by the applicable travel supplier will appear on your monthly card statement as "Trip Charges." Bank of the West's ("Bank") provider of travel services ("Travel Services") has the right to cancel the booking in the event of non-payment or payment dispute. All refund requests must be made in writing and any negotiable documents (i.e. airline tickets, redeemable certificates or vouchers, etc.) issued by Travel Services must be returned prior to transaction of any refund. All refund claims must be submitted within 30 days after the scheduled departure date. Special cancellation provisions may apply to group, holiday, and school vacation reservations. Card Declines - In the event that your card is declined, Travel Services will attempt payment up to two additional times and will attempt to contact you. If we are unable to obtain authorization for the charge, your package will be subject to cancellation, and standard penalties will be applied.

Airline policies are subject to change at any time without notice. Airline tickets are NON-REFUNDABLE and NON-CHANGEABLE unless permitted by the terms of the fare and are subject to airline rules, penalties, and fare difference. Unused tickets contain no value if not canceled prior to departure. Tickets may not be reassigned or transferred to a different passenger or airline. Airline passengers must present applicable travel documents at the airport on the day of travel along with a government issued photo identity card. It is recommended that passengers check in with the airline a minimum of 75 minutes prior to scheduled departure time for domestic flight itineraries and 3 hours prior to scheduled departure time for international itineraries due to federal security requirements. Please note that airline schedules change frequently. Please reconfirm all flight dates and times with the airline 72 hours prior to departure. Upgrades are not permitted on certain itineraries. Please check with the carrier directly. Turboprop aircraft may exist on your itinerary. Airlines reserve the right to change aircraft equipment without notice to the booking travel agency or the consumer. Please review your itinerary, as code-share flights may exist. If a code-share flight exists in your itinerary, passengers must check in with the operating airline on day of departure.

Please contact Travel Services directly for any special requests. Special requests made to hotel properties are on a request only basis and cannot be guaranteed. Fees and charges may apply, depending on the service request. The hotel property may require a major credit card, in the name of the guest(s), or a cash deposit upon check-in. Reservations do not include services not specified in the reservation confirmation. Every reasonable attempt will be made to notify guests of hotel property renovation or refurbishment; however, Travel Services shall not be liable for non-disclosure by the hotel property.

Hotel Taxes and Fees, and Booking Tax Recovery Fee for Non-Point Transactions: •









In connection with facilitating your hotel transaction, the charge to your debit or credit card will include a charge for Taxes and Fees. This charge includes an estimated amount to recover the amount paid to the hotel property in connection with your reservation for taxes owed by the hotel property including, without limitation, sales and use tax, occupancy tax, room tax, excise tax, value-added tax and/or other similar taxes. In certain locations, the tax amount may also include government imposed service fees or other fees not paid directly to the taxing authorities but required by law to be collected by the hotel property. The amount paid to the hotel in connection with your reservation for taxes may vary from the amount estimated and included in the charge to you. The balance of the charge for Taxes and Fees above is a nongovernment imposed "Booking Tax Recovery Fee" that is imposed and retained by Travel Services as part of the compensation for services and to cover the costs of your reservation, including, for example, customer service costs. The charge for Taxes and Fees varies based on a number of factors including, without limitation, the amount paid to the hotel property and the location of the hotel property where you will be staying, and may include profit. Except as described below, we are not the vendor collecting and remitting taxes to the applicable taxing authorities. Our hotel suppliers, as vendors, include all applicable taxes in the amount billed to us and we pay over such amounts directly to the vendors. We are not a co-vendor associated with the vendor with whom we book or reserve our customer's travel arrangements. Taxability and the appropriate tax rate and the type of applicable taxes vary greatly by location. For transactions involving hotel properties located within certain jurisdictions, the charge to your debit or credit card for Taxes and Fees includes a payment of tax that we are required to collect and remit to the jurisdiction for tax owed on amounts retained as compensation for services. Please note that we are unable to facilitate a rebate of Canadian Goods and Services Tax ("GST") for customers booking Canadian hotel accommodations utilizing our services.

Rental rates are based on 24 hour periods and may be subject to additional fees depending on time of return, including but not limited to hourly rental charges which will be billed directly to you by the car rental company. Redemption and Advance Purchase rental rates include unlimited mileage, taxes and fees. For reservationonly or courtesy hold rentals, rates are subject to taxes and fees as advised in the car policy and may vary by car rental company. Charges are billed directly by the car rental company and subject to change. Local taxes and fees may not be included and will be assessed by the car rental location directly and are the responsibility of the consumer. Charges for optional services such as insurance waivers, fuel, additional or underage drivers, special equipment charges, etc. are not included in your rental and must be paid directly by you to the car rental company. Geographic restrictions may apply. Renters must be 25 years of age and have a valid driver's license, major credit card, and good driving record. One way rentals are not permitted on this Site. Travel Guard is a third party insurer and has no direct affiliation with Bank. If travel insurance was purchased, you will receive an email confirmation including your policy number and specific details of your policy within 24 hours. Please review your policy details immediately upon receipt for important coverage information. Travel insurance coverage will not cover Travel Services' cancellation fees. Travel Services has the right to cancel the booking in the event of non-payment or payment dispute. All refund requests must be made in writing and any negotiable documents (i.e., airline tickets, redeemable certificates, or vouchers, etc.) issued by Travel Services must be returned prior to processing of any refund. All refund claims must be submitted within 30 days after the scheduled departure date. Special cancellation provisions may apply to group, holiday, and school vacation reservations. In the event that your credit card is declined, Travel Services will attempt payment up to two additional times and will attempt to contact you. If we are unable to obtain authorization, your package will be subject to cancellation and standard penalties will be applied. Please note that customers who choose not to select the travel insurance option are fully responsible for any potential losses that may arise from their travels.

Destination Taxes

Airport departure or entry taxes may not be included in ticket taxes. Passengers should be prepared to pay these taxes in cash on location.

Passport Requirement

All international itineraries require a valid passport. Visa policies vary by country, should be obtained prior to departure, and are the sole responsibility of the traveler. Travelers are responsible for ascertaining, obtaining, and possessing all required documentation needed for travel to your destination and it is strongly recommended that both U.S. and non-U.S. citizens verify current entry requirements before making reservations. Children under the age of 18 who are traveling with only one parent may be required to have additional documentation if leaving their country of residence. Please contact the nearest Consulate of the country to which you are traveling for additional information. The airline cannot board any passenger who fails to carry required proof of citizenship documents. No refunds will be made if improper documentation results in denial of boarding aircraft or entry to a foreign country. Responsibility

Travel Services acts only as agents for the passenger in regards to travel, whether by air, automobile, ship, or any other conveyance or activity, and assumes no liability for injury, damage, loss, accident, delay or irregularity, which may be caused due to defect in any vehicle, acts of God, war, riots, or for any company or person involved in conveying the passenger or in carrying out arrangements of any tour. The Bank, Travel Services, and their respective agents and affiliates cannot accept any responsibility for losses or additional expenses due to delay or changes in schedules or other causes such as strikes, labor disputes, government actions, weather, or any other causes beyond their control. All such losses will be the responsibility of the passenger. Travel Services reserves the right to make minor adjustments in your itinerary. All rates published in any venue are based on exchange rates and tariffs and are subject to change. All taxes, gratuities, and porterage charges are subject to deletions, additions or changes without notice. These items are not covered under the control of the Bank or Travel Services, since changes in Government regulations and labor agreements cannot always be anticipated in advance. The Bank, Travel Services, and their respective affiliates are not responsible for any changes initiated by the passenger after departure. The Bank, Travel Services and their respective agents and affiliates are not responsible for errors and/or omissions.
