LIVESTOCK DEALER LETTER OF AUTHORIZATION (for sale of livestock by Livestock Dealer only) F-1 Version 2010-04-22
INFORMATION AND INSTRUCTIONS This form can be used by a livestock owner or a brand owner to authorize a licensed livestock dealer to sell livestock on the owner’s behalf. The obligations of purchasers and sellers with respect to the sale of livestock and the requirement for sellers to provide a livestock security interest declaration is found in Part 2 of the Livestock Identification and Commerce Act and Part 4 of the Livestock Identification and Commerce General Regulation. The sale of livestock by a livestock dealer on behalf of the owner of the livestock is governed by Part 3 of the Livestock Identification and Commerce Act and Part 5 of the Livestock Identification and Commerce General Regulation. The purpose of livestock inspection is for the Livestock Inspector to be satisfied that the person in possession of the livestock is the owner of the livestock, the owner’s agent or otherwise entitled to be in possession of the livestock. In the case of the sale of livestock, the Livestock Inspector must be satisfied that the person in possession of the livestock is entitled to the sale proceeds. Livestock Inspectors will ask livestock owners to complete a Livestock Dealer Letter of Authorization to satisfy them that the livestock dealer is authorized to sell the livestock on the owner’s behalf. The sale proceeds received by a livestock dealer as a result of a transaction authorized by a Livestock Dealer Letter of Authorization are required to be paid into the livestock dealer’s trust account. Completing the Letter of Authorization The owner of the livestock is required to complete the Livestock Dealer Letter of Authorization and sign the form in front of a witness. Both the owner and the witness are required to print their name, address and phone number on the form. Any revocation of the Livestock Dealer Letter of Authorization must be in form attached and completed by the person signing the letter of authorization. As required by the Livestock Identification and Commerce Act, the owner(s) has/have provided the above named livestock dealer with a Livestock Security Interest Declaration with respect to the livestock or the dam of the livestock being sold by the livestock dealer on behalf of the owner(s).

In consideration of LIS accepting this Livestock Dealer Letter of Authorization, the owner of the livestock agrees that LIS is not liable for any loss the owner may suffer as a result of LIS allowing the sale to proceed or as a result of LIS permitting the sale proceeds to be paid to the above noted livestock dealer on behalf of the owner of the livestock. The owner of the livestock further agrees to indemnify and hold harmless LIS, its officers, directors, employees and agents for any loss, damage, claims, costs (including legal fees on a full indemnity basis) that LIS may be required to pay to anyone as a result of LIS acting in accordance with the Livestock Dealer Letter of Authorization.

The owner agrees that LIS is entitled to rely on this Livestock Dealer Letter of Authorization until the earlier of: •

December 31 of the second year following the date the Livestock Dealer Letter of Authorization was signed (for example, if signed on October 10, 2009 the authorization will expire on December 31, 2011), or

five (5) business days following LIS acknowledging receipt of a Revocation of Livestock Dealer Letter of Authorization in the prescribed form.
