2015 Columbus International Auto Show Ugly Car Giveaway Official Rules NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR WIN. PURCHASE DOES NOT INCREASE ODDS OF WINNING. 1. All Entrants must be 18 years of age, and must be a legal resident of Ohio. Void where prohibited by law. 2. Contest Sponsored by Columbus Automobile Dealers Association and Central Ohio Honda Dealers (“Sponsor”). Employees of the Columbus Automobile Dealers Association, its members, and their immediate families are not eligible to participate. Employees of Central Ohio Honda Dealers and its members, and their immediate families are not eligible to participate. Employees of the Columbus Convention Center and their immediate families are not eligible to participate. 3. You may enter the Contest during the “Entry Period” beginning at 12:00 AM on February 28h, 2015 and ending at 11:59 PM on March 8th, 2015, by taking a photo of your automobile and uploading it to the Contest Page accessible via the Columbus International Auto Show’s Facebook page at https://www.facebook.com/ColumbusInternationalAutoShow or the Columbus International Auto Show Website at http://columbusautoshow.com/ or the Central Ohio Honda Dealers’ Website at http://www.centralohiohondadealers.com/. Entrant must follow directions for uploading photo on Contest Page. Entrant must be able to provide proof of ownership of vehicle entered in order to participate in the contest. Examples of proof of ownership include copy of title or registration. Voting will be open to the general public via the contest page and voters will select the car that they believe to be the ugliest car and, thus, the person most deserving of a new car. 4. Alternate Method of Entry- Entrant may submit a photo of their vehicle and their contact information, including phone number, address, and e-mail address, via the United States Postal Service to The Columbus Automobile Dealers Association, 655 Metro Place South, Suite 270, Dublin, OH 43017. The photo will then be scanned and uploaded to the Contest Page to participate. All entries must be received by 11:59 PM on March 8th, 2015. 5. In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed to be submitted by the person in whose name the social media account is registered. For purposes of these official rules, all times are Eastern Standard Time and Sponsor’s computer is the official time-keeping device for the Giveaway. 6. Airtime, message, and data rates may apply for app download and use. Available on select smartphones. Coverage not available everywhere. Contact your carrier for rates applicable to your plan. Wireless service providers may charge entrants for data used in connection with the Contest based on the applicable wireless service pricing plan. Entrants should consult their wireless service provider’s pricing plan for details. Proof of posting is not considered proof of delivery or receipt of entry to play. Decisions of the contest judges are final. Such decisions may include, but are not limited to, whether an entry adheres to the entry criteria, the time of entry receipt, and the eligibility of the entrant. By participating, entrants agree that Sponsor may contact them via the social media platform from which the entry was initiated or via the contact information submitted with entry. 7. Entries must be received and recorded by the Sponsor’s computer before the end of the Entry Period at 11:59 PM on March 8th, 2015. Any entry received or made after the official Entry Period will not be valid and will not be deemed eligible. The Sponsor’s computer is the official timekeeping device for this Contest. The Sponsor is not responsible for service outages, message failures, transmission delays or any other factor affecting the availability or performance of the data services. 8. If, in Sponsor’s opinion, there is any suspected or actual evidence of fraud, electronic or non-electronic tampering or unauthorized intervention with any portion of this Contest, or if fraud or technical difficulties of any sort (e.g., computer viruses, bugs) compromise the integrity of the Contest, Sponsor reserves the right to void suspect entry or votes and/or terminate the Contest and award the Prize in its sole discretion. The use of any automated launching or entry software or any other mechanical or electronic means that permits the participant to automatically enter or vote repeatedly is prohibited. 9. The Sponsor is not responsible for lost entries, technical failures, or unauthorized human intervention. SUBMISSION GUIDELINES FOR USER CONTENT: Any content submitted to the Company must adhere to these guidelines. Any content must be acceptable under the Federal Communication Commission’s standards, including no use of indecent or obscene material or language. Content should not infringe or violate any copyright, patent, trademark, trade secret, right of publicity, or other intellectual property, proprietary, or contractual right of a third party. pornographic; no misrepresentation or disparaging remarks about Sponsor or its products, or other people, products or companies; no content which implies or portrays graphic violence excessive use of alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous; no content which is abusive or harassing towards any individual or group of individuals regarding race, sex, religion, creed, national origin, age, disability, gender identity or expression, sexual orientation or any legally protected classification (Specifically this includes, but is not limited to, epithets or slurs, threats, intimidations, or hostile acts); no content communicating messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate. Entries must be socially acceptable and in good taste, as determined by the Sponsor and in the Sponsor’s sole discretion. Entries cannot depict, and cannot itself, be in violation of any law. Entries cannot contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead, without permission. Entries which the judges determine, at their discretion, to be incomplete, incorrect, illegible, or not in accordance with these rules will be disqualified without notice to the entrant. Voting- Once entry has been completed, the photos entered in accordance with these rules will be posted both on Columbus International Auto Show’s Facebook page and the Official Contest Homepage. The photos will then be open to voting by the general public on the Official Contest Homepage. The “Voting Period” will begin at 12:00 AM on March 9th, 2015 and end at 12:00 PM on March 15th, 2015. The three entrants with the most votes at the end of the Voting Period will be selected as finalists. Limit one (1) vote per person per twenty-four (24) hour period. While reasonable attempts to notify finalists will be made, it is the responsibility of the finalist to be available for notification. Finalist must respond within twenty-four (24) hours of notification. In the case where a finalist has not responded to Sponsor within twenty-four (24) hours, finalist forfeits opportunity to win, and a replacement finalist will be chosen. Sponsor will contact finalists via the phone number entered on the contest entry form. A display will be created at the Columbus International Auto Show with finalist’s entered vehicles. Finalists must be able to display the entered vehicle at the Columbus International Auto Show from Wednesday, March 18th, 2015 to Sunday, March 22nd, 2015 at 6:00 PM. Move in of the vehicle on March 18th, 2015 must occur between 2:00PM and 7:00 PM. In the case where a finalist is unable to display the entered vehicle at the Columbus International Auto Show, finalist forfeits opportunity to win, and a replacement finalist will be chosen. Voting will be open to attendees at the Columbus International Auto Show. All previous votes will be discarded and voting for a winner from the three finalists will begin at zero (0). Voting will take place during the Columbus International Auto Show during official “Secondary Voting Period” (Thursday- 12:00PM to 9:00PM, Friday12:00PM to 9:00PM, Saturday- 10:00AM to 9:00PM, and Sunday- 10:00AM to 2:00PM). In order to vote, auto show attendees will complete a ballot designating their vote and place it in the box in front of the vehicle they wish to vote for. The finalist with the most votes at the end of the Voting Period will be the winner. Finalist must be able to provide proof of ownership of the vehicle entered upon being notified that he or she is a finalist. Finalist must be available to be at the Columbus International Auto Show Sunday, March 22nd, 2015, from 3:00 PM to 5:00 PM for winner presentation. Finalist agrees that a representative of the Auto Show or their designee may take a photo or photos of the finalist’s vehicle for display at the Columbus Convention Center during the official “Secondary Voting Period.” The prize to be awarded will be: one (1) Honda Accord LX (MSRP $22,105). The Sponsor is not responsible for and shall not be liable for late, misdirected or unsuccessful efforts to notify a finalist or potential winner. If the potential finalist or winner does not claim the prize within the appropriate time given upon notification or unless otherwise stated herein, the entrant will automatically be disqualified and their prize will be forfeited. Furthermore, eligible entrants agree as follows: By participating, you agree (a) to be bound by these Official Rules; (b) as between you and the Sponsor, that the decisions of the Sponsor is final on all matters relating to the Contest; (c) you are not participating on behalf of any employer or third party; (d) in the event that you not comply with the rules, then the eligible winner will be disqualified. No representatives or agents may claim the prize on the winner’s behalf. The winner is solely responsible for all applicable taxes, and titling, registration, and insurance fees and any and all other expenses not specifically listed herein that are incurred. 23. In the event viruses, bugs, unauthorized human intervention, Acts of God, acts or regulations of any governmental authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Sponsor’s reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of the Giveaway, so that it cannot be conducted as originally planned, except where prohibited by law, Sponsor has the right, in its sole discretion, to modify the Official Rules or to cancel, modify, terminate or suspend the Giveaway; and in such event, to select a winner by such method as Sponsor in its sole discretion shall consider equitable; 24. By entering the contest, entrants agree to be bound by the Official Rules, and agree that Sponsor shall have the right, free of charge, to publish and/or broadcast by any means the name, city of residence, photographs, video, and statements of the finalists or winner. 25. Finalists and potential winner’s name and likeness may be published and may be used for promotion or publication in the future. Finalists’ and winner’s name and likeness may be published on the Central Ohio Honda Dealers Association website at www.centralohiohondadealers.com. Except where prohibited, the potential winner will be required to sign and return an Affidavit of Eligibility and Liability & Publicity Release ("Affidavit"). If a finalist cannot be contacted, fails to execute and return the Affidavit, does not comply with these Official Rules, or does not take delivery of the prize in a reasonable time period, the potential winner forfeits the prize. 26. By entering the Contest, entrants grant Sponsor the right to like, re-tweet, re-post or otherwise reproduce the entrants’ submissions, including, but not limited to, any photos, image, text or username associated with the submission. Sponsor does not control and is not responsible or liable for any further republication. By entering the contest, entrants agree that Sponsor shall have the right, free of charge, to publish and/or broadcast by any means the photograph submitted for any purpose including, but not limited to, promotion of the Contest and promotion of future contests. 27. By participating, entrant acknowledges that the contest is not endorsed, sponsored, or administered by, or associated with Facebook or the Columbus International Auto Show and that participant releases and agrees to hold harmless Facebook, the Columbus International Auto Show, its affiliates, subsidiaries, and the directors, officers, agents and employees of any of the organizations, from all claims or damages, in equity or in law, arising out of participation in the contest. 28. By participating, entrant agrees to release and hold harmless sponsors, affiliates, subsidiaries, and the directors, officers, agents and employees of any of the organizations, from all claims or damages, in equity or in law, arising out of participation in the contest as well as any and all liability arising from the acceptance and/or use/misuse of the prize. The winner must present a valid drivers’ license with his/her photograph, name and address, proof of social security number, proof of vehicle ownership, and sign an affidavit of eligibility and release to claim the prize. Should the winner be deemed ineligible at the time of the drawing or subsequently at the time of delivery, according to the official rules, he/she will be automatically disqualified and will receive no compensation. A replacement winner will be selected. No cash substitution, transfer or assignment of prize allowed, except at the sole discretion of the sponsors. 29. Prize- ALL WARRANTIES, IF ANY, BY THE MANUFACTURER ARE THEIRS, NOT THE SPONSORS, AND ONLY THE MANUFACTURER SHALL BE LIABLE FOR PERFORMANCE UNDER SUCH WARRANTIES. SPONSORS HEREBY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. 30. The prize(s) that may be awarded to the eligible winner is not transferable, redeemable for cash or exchangeable for any other prize, except in the Sponsor’s sole discretion. Certain prizes are date specific and the finalists or winner must be available on the dates specified. If a finalist cannot be contacted, has not responded within twenty-four (24) hours, or is disqualified for any reason, a replacement finalist will be chosen. By participating in a contest in which social media based entry is permitted, entrants acknowledge that social media accounts are distributed and delivered through third party providers; the Sponsor does not guarantee, and shall not be responsible for, the delivery or timeliness of any entry. Entrants may use the alternative entry method. The Sponsor will at all times consider the time that a message is logged as arriving in its system as being the time of entry, regardless of the time at which the entrant attempted to send the entry and any technical problems or other complications that may have delayed its delivery. 31.
