SENATE BILL NO. 2716 (Second Reprint)
To the Senate: Pursuant to Article V, Section I, Paragraph 14 of the New Jersey Constitution, I am returning Senate Bill No. 2716 (Second Reprint) with my recommendations for reconsideration. I support the sponsor’s intent to extend the moratorium on non-residential development fees until 2016.
This moratorium
was first enacted in the midst of a great recession and, in 2011, I signed a law extending the fee moratorium until July 1, 2013.
Although
progress,
the
New
State
Jersey’s still
economy
faces
has
myriad
made
significant
economic
challenges,
including the continuing challenge of recovering from Superstorm Sandy.
Lifting the moratorium on non-residential development
fees at this time is therefore unwise. However, I cannot support the portion of this bill that once
again
seeks
to
establish
the
“New
Jersey
Residential
Foreclosure Transformation Act,” a proposal I have already twice vetoed.
The State is committed to helping its citizens avoid
foreclosure through the New Jersey Housing and Mortgage Finance Agency’s mortgage foreclosure prevention programs.
Sending the
“New Jersey Residential Foreclosure Transformation Act” to me for a third time is not the charm.
As I have said many times
before, I cannot support bills that provide for spending outside the budget process for the coming fiscal year. Accordingly, I am recommending that the bill be amended to provide
only
for
the
extension
of
residential development fees until 2016.
