SUMMARY This staff report is about a matter for which the Community Council has the delegated authority from City Council to make a final decision. Tucker Hi-Rise Construction Inc. is constructing a 29-storey condominium building at 75 St. Nicholas Street, on the southeast corner of St. Nicholas Street and St. Mary Street. They need to close the east sidewalk on St. Nicholas Street and the south side of St. Mary Street in order to do their work.

RECOMMENDATIONS Transportation Services recommends that Toronto and East York Community Council: 1.

Approve the closure of the east sidewalk on St. Nicholas Street, between St. Mary Street and a point 51.8 metres south of St. Mary Street, from November 3, 2011 to April 30, 2014.

2.

Approve the closure of the parking lane and sidewalk on the south side of St. Mary Street, between St. Nicholas Street and a point 27.6 metres east of St. Nicholas Street, from November 3, 2011 to April 30, 2014.

3.

Approve the removal of the existing "No Parking Anytime" restriction on the east side of St. Nicholas Street, between St. Mary Street and a point 51.8 metres south of St. Mary Street.

Approve the implementation of a "No Stopping Anytime" restriction on the east side of St. Nicholas Street, between St. Mary Street and a point 51.8 metres south of St. Mary Street, from November 3, 2011 to April 30, 2014.

Approve the removal of the existing "No Parking Anytime" restriction on the south side of St. Mary Street, between St. Nicholas Street and Yonge Street.

6.

Approve the implementation of a "No Stopping Anytime" restriction on the south side of St. Mary Street, between St. Nicholas Street and a point 41.4 metres east of St. Nicholas Street, from November 3, 2011 to April 30, 2014.

7.

Approve the implementation of an "Overnight Permit Parking, 10:00 p.m. to 7:00 a.m." restriction on the south side of St. Mary Street, between a point 41.4 metres east of St. Nicholas Street and Yonge Street.

8.

Approve the implementation of "Pay & Display Parking, 8:00 a.m. to 9:00 p.m., Monday to Saturday; 1:00 p.m. to 9:00 p.m. Sunday" restriction on the south side of St. Mary Street, between a point 41.4 metres east of St. Nicholas Street and Yonge Street.

Direct that St. Nicholas Street and St. Mary Street be returned to their preconstruction traffic and parking regulations when the project is complete.

Financial Impact There is no financial impact on the City. Tucker Hi-Rise Construction Ltd. is responsible for all costs, including payment of fees to the City for the occupancy of the right of way. Based on the area enclosed and projected duration of the closure, these fees will be approximately $63,000.00.

DECISION HISTORY City Council, at its meeting on October 26 and 27, 2009, adopted Item 28.5 of the Toronto and East York Community Council to amend the General Zoning By-law No. 438-86, with respect to lands known as 15 St. Mary Street, 65 and 67 St. Nicholas Street, and the rear portion of 692 Yonge Street. Toronto and East York Community Council, at its meeting on June 22, 2011, adopted Item TE8.45, to close a portion of the public laneway east of St. Nicholas Street, south of St. Mary Street, and remove the existing parking on the south side of St. Mary Street, between St. Nicholas Street and Yonge Street, to accommodate the initial construction staging needs for this project.

ISSUE BACKGROUND Transportation Services has received an application from Tucker Hi-Rise Construction Ltd. for a temporary closure of the east sidewalk on St. Nicholas Street, between St. Mary Street and a point 51.8 metres south of St. Mary Street, and the parking lane and sidewalk on the south side of St. Mary Street, between St. Nicholas Street and a point 27.6 metres

east of St. Nicholas Street. Chapter 937-2 of the Municipal Code authorizes staff to issue road closure permits of up to 30 days for private construction. This closure will be in effect for 30 months and needs Toronto and East York Community Council’s approval.

COMMENTS St. Nicholas Street, between St. Mary Street and a point 51.8 metres south of St. Mary Street, is 7 metres wide and operates two-way. It is regulated by "No Parking Anytime" restrictions on both sides of the street. There are no T.T.C. routes on this portion of St. Nicholas Street. St. Mary Street, between St. Nicholas Street and a point 27.6 metres east of St. Nicholas Street, is 7.3 metres wide and operates one-way in the eastbound direction. It is regulated by "No Parking Anytime" restrictions on both sides of the street. There are no T.T.C. routes on this portion of St. Mary Street. The "No Parking Anytime" restriction on the south side of St. Mary Street was implemented following the approval of Item TE8.45, where the existing Overnight Permit Parking and Pay and Display parking regulations were removed to accommodate the initial construction needs at the site. Tucker Hi-Rise has since advised us that they only need three of the former five parking spaces on the south side of the street for their work. Therefore, the previous Overnight Permit Parking and Pay and Display parking regulations can be reinstated for two parking spaces on the south side of St. Mary Street, between a point 41.4 metres east of St. Nicholas Street and Yonge Street. Reasons for the partial road closure Developing this property means excavating the entire site to a depth of 20 metres. The applicant needs construction staging areas within the road allowance in order to construct the building. Pedestrians will be redirected to the west side of St. Nicholas Street and the north side of St. Mary Street while the work is taking place.
