The Orange County District Attorney charges that in Orange County, California, the law was violated as follows: COUNT 1: On or about December 16, 2010, in violation of Section 245(d)(2) of the Penal Code (ASSAULT WITH A SEMIAUTOMATIC FIREARM ON PEACE OFFICER OR FIREFIGHTER), a FELONY, BRINDA SUE MCCOY did willfully and unlawfully commit an assault with a semiautomatic firearm upon the person of Officer G. Faessel, who was a peace officer engaged in the performance of duty, and the defendant knew and reasonably should have known that Officer G. Faessel was a peace officer engaged in the performance of duty. COUNT 2: On or about December 16, 2010, in violation of Section 245(d)(2) of the Penal Code (ASSAULT WITH A SEMIAUTOMATIC FIREARM ON PEACE OFFICER OR FIREFIGHTER), a FELONY, BRINDA SUE MCCOY did willfully and unlawfully commit an assault with a semiautomatic firearm upon the person of Officer C. Pryor, who was a peace officer engaged in the performance of duty, and the defendant knew and reasonably should have known that Officer C. Pryor was a peace officer engaged in the performance of duty.

BRINDA SUE MCCOY CYPD 10-04169 PAGE 2 COUNT 3: On or about December 16, 2010, in violation of Section 245(d)(2) of the Penal Code (ASSAULT WITH A SEMIAUTOMATIC FIREARM ON PEACE OFFICER OR FIREFIGHTER), a FELONY, BRINDA SUE MCCOY did willfully and unlawfully commit an assault with a semiautomatic firearm upon the person of Sergeant Healy, who was a peace officer engaged in the performance of duty, and the defendant knew and reasonably should have known that Sergeant Healy was a peace officer engaged in the performance of duty. COUNT 4: On or about December 16, 2010, in violation of Section 245(d)(2) of the Penal Code (ASSAULT WITH A SEMIAUTOMATIC FIREARM ON PEACE OFFICER OR FIREFIGHTER), a FELONY, BRINDA SUE MCCOY did willfully and unlawfully commit an assault with a semiautomatic firearm upon the person of Officer S. Singer, who was a peace officer engaged in the performance of duty, and the defendant knew and reasonably should have known that Officer S. Singer was a peace officer engaged in the performance of duty. COUNT 5: On or about December 16, 2010, in violation of Section 245(d)(2) of the Penal Code (ASSAULT WITH A SEMIAUTOMATIC FIREARM ON PEACE OFFICER OR FIREFIGHTER), a FELONY, BRINDA SUE MCCOY did willfully and unlawfully commit an assault with a semiautomatic firearm upon the person of Officer R. Mathias, who was a peace officer engaged in the performance of duty, and the defendant knew and reasonably should have known that Officer R. Mathias was a peace officer engaged in the performance of duty. COUNT 6: On or about December 16, 2010, in violation of Section 246.3(a) of the Penal Code (DISCHARGING FIREARM WITH GROSS NEGLIGENCE), a FELONY, BRINDA SUE MCCOY did willfully and unlawfully discharge a firearm in a grossly negligent manner which could have resulted in injury and death to a person. COUNT 7: On or about December 16, 2010, in violation of Section 246.3(a) of the Penal Code (DISCHARGING FIREARM WITH GROSS NEGLIGENCE), a FELONY, BRINDA SUE MCCOY did willfully and unlawfully discharge a firearm in a grossly negligent manner which could have resulted in injury and death to a person. / / / / / FELONY COMPLAINT WARRANT (DA CASE# 10F15513) OC DNA NOT ON FILE: BRINDA MCCOY

BRINDA SUE MCCOY CYPD 10-04169 PAGE 3 ENHANCEMENT(S) As to Count(s) 1, 2, 3 and 4, it is further alleged pursuant to Penal Code section 12022.53(c) (PERSONAL DISCHARGE OF FIREARM), and within the meaning of Penal Code sections 1192.7 and 667.5, that defendant BRINDA SUE MCCOY intentionally and personally discharged a firearm during the commission and attempted commission of the above offense. As to Count(s) 5, it is further alleged pursuant to Penal Code section 12022.53(c) (PERSONAL DISCHARGE OF FIREARM), and within the meaning of Penal Code sections 1192.7 and 667.5, that defendant BRINDA SUE MCCOY intentionally and personally discharged a firearm during the commission and attempted commission of the above offense.
