Medical Superintendent ESI Hospital, Rohini on any working day from 10 A.M. to 3 P.M. & on Saturday from 10am to 12noon at the cost of Rs 200/- in the form of demand draft/Banker Cheque(Non Refundable) in favour of ESIC FUND ACCOUNT No. 1, New Delhi. Tender documents can also be downloaded from Website- www.esic.nic.in ; in that case DD/Banker Cheque for the cost of tender document is to be enclosed with tender. Tender form is to be submitted complete in all respects along with prescribed EMD in favour of ESIC FUND ACCOUNT No.1 New Delhi in form of DD or Banker cheque only. NOTICE INVITING TENDER FOR SUPPLY OF MEDICAL BOOKS & MEDICAL JOURNALS Sealed quotations are invited on behalf of the Medical Superintendent for supply of Medical Books, Medical Journals & Periodicals in ESI Hospital, Sector15,Rohini,Delhi from eligible Publishers/Booksellers having annual turnover of Rs. 50 lakhs or above during the last financial year in the books of account and having at least three years experience of supplying Medical Books, /Scientific/Technical/ Journals and Periodicals(Indian & Foreign) to Medical Colleges libraries/ Government of India libraries situated in Delhi/New Delhi.
Prescribed Tender documents containing Terms and Conditions can be obtained in person on submission of written request along with a Demand Draft of Rs. 200/- (non-refundable) in favour of “ESIC Fund Account No. 1” from the Medical store of the hospital on all working days except Closed/ Public Holidays between 10 A.M. to 3 P.M. & on Saturday from 10am to 12noon w. e. f. 16.03.10 to 29.03.10. The tender document can also be downloaded from the hospital website www.esic.nic.in which should be accompanied by the requisite Tender cost of Rs. 200/- in the form of demand draft/pay order payable at New Delhi in favour of “ESI Fund Account No. 1”.
Sealed Tenders duly filled up along with Earnest Money of Rs. 50,000/- in the form of Demand Draft/ Banker’s Cheque issued by any Nationalized Bank/Commercial Bank should be dropped in a Tender Box kept in the Chamber of the Dy. Medical Superintendent 10 A.M. to 3 P.M. & on Saturday from 10am to 12 noon from 16.03.10 to 29.03.10. 1) TENDER VALIDITY Tender shall remain open for acceptance for a period of 120 days from the date of opening of Tender. Tenders received for shorter validity will be rejected. 3) TENDERER’S ELIGIBILITY AND QUALIFICATIONS Sealed quotations are invited from eligible Publishers/Booksellers having annual turnover of Rs. 50 lacs or above during the last financial year in the books of account and having at least three years experience of supplying Medical Books / Scientific/Technical/ Medical Journals and Periodicals(Indian & Foreign) to Medical Colleges libraries/Government of India libraries situated in Delhi/New Delhi. The bidders who are in a position to supply 75% or above the required quantity of books will be treated eligible to participate in the tender. The tenderer shall furnish, as a part of the tender document, following documents establishing their eligibility to participate in the tender and qualification to perform the contract. a)
Copy of PAN card issued by the Income Tax Department and Copy of the Income Tax Return for the financial year 2008-09.
b)
Annual turnover of last financial year (2008-09) duly certified by the Statutory Auditors.
c)
Name and address of the bankers with satisfactory bankers report regarding Tenderers’ financial capability for doing business worth Rs.50 lakhs or above in a year.
d)

At least 3 years experience in supply of Medical Books/Scientific/Technical/ Medical Journals and Periodicals (Indian and Foreign) to Medical Colleges libraries/Government of India libraries situated in Delhi/New Delhi (Attach Certificate from 3 libraries served) Declaration regarding availability of books in ready stock.
4) QUALIFICATION OF THE BIDDERS:3.1.
The Bidder, to qualify for the award of contract, shall submit a written power of attorney authorizing the signatories of the bid to participate in the bid. 3.2. The bidder shall submit full details of his Agency / Firm or, if the bidder is a Proprietorship/Partnership or a Private Limited Company, full details of ownership and name of the directors. 3.3.
Bidder shall submit a copy of PAN card No. under the Income Tax Act.
3.4. Bidder must submit self-attested copies of all documents and each & every page of tender document duly signed by him. 5)
EARNEST MONEY DEPOSIT Tenderer shall furnish along with their tender, a Earnest Money for Rs.50,000/- (Rupees Fifty thousand only) in the form of crossed Demand draft in favour of ESIC Fund Account No.1 Failure of the tenderer to furnish required earnest money deposit along with their tender will result into rejection of their tender. The tender security is required to protect the ESI Hospital, sector-15, Rohini, Delhi against risk of tenderer’s conduct in the following eventualities which would warrant the forfeiture of Earnest Money. In case the tenderer withdraws its tender or impairs or derogates from the tender in any respect during the period of tender validity as specified by the purchaser, OR

In case successful tenderer fails to furnish the performance security. ii. The Earnest Money of unsuccessful bidders will be returned as promptly as possible after the expiry of the period of tender validity without interest. 6) DETAILS OF REQUIREMENTS:a) b) c)
Supply of Medical Books (as per list at Annexure-A). Supply of Medical Journals and Periodicals published for subscription year 2010-11 (as per list at Annexure-B) Demand may be increased or decreased depending on demand.
7(1) PRICE SCHEDULE AND PAYMENT TERMS:a)
Tenderers should quote rate of discount (in percentage) offered on publishers’ printed price in Annexure-A & B. Medical Superintendent is not bound to accept the lowest bid or any tender and also reserves the right of rejecting all or any of the tender without assigning any reason.
b)
The current bank exchange rate (TT selling rate) on the date of purchase order for Medical Books shall be used for conversion of foreign currencies supported by a certificate issued by a scheduled bank and countersigned by the supplier. All payments will be made in Indian rupees only.
c)
Net payable price will be the publishers’ printed price or (in case of price in foreign currency) equivalent price in INR minus discount offered.
d)
Rates for Medical Journals & Periodicals shall be net amount arrived at after discount on the rates shown in the Publishers’ Price Lists/Catalog in Indian or Foreign Currency for subscription year 2010-11. The conversion rates in Indian Currency will be as per rates on the date on which the Draft remittance has been made to the Foreign Publishers. Proof of remittance has to be produced to the Medical Superintendent, ESI Hospital, Sector-15, Rohini, Delhi-85.

Bill in triplicate (pre-receipted) for the Medical Books supplied will be submitted by the tenderer in the name of Medical Superintendent, ESI Hospital, Sector-15, Rohini. for payment. The payment will be released only after the entire supply has been received to the satisfaction of the Medical Superintendent.
f)
The bill should bear the certificate from the supplier that only books of latest edition(s) have been supplied and that the prices have been charged correctly and in accordance with the latest publishers catalogue/invoice or importer/distributors invoice.
7(2) The payment for Medical Journals and Periodicals can be made in advance to the firm if so desired against Bank Guarantee of an equivalent amount valid for a period of six months in 1st instance and thereafter it shall be further extended/renewed for another suitable spell of period(s) on the remaining amount vis-a-viz depending upon the quantum of supply actually received and subsequently reconciled. The process shall have to be completed well in advance of the expiry of original Bank Guarantee. 8. TERMS OF DELIVERY:Free of cost delivery at Library Department, ESI Hospital, Sector-15, Rohini, Delhi-15 9. DELIVERY PERIOD:9.1 Medical Books a) The Medical Books available in India will be supplied within 30 days of placing the order. In case books imported from foreign publishers, the supplies should be completed within 45 days from the date of purchase order. 9.2 Medical Journals & Periodicals a)
Medical Journals & Periodicals should be supplied as soon as published or become available in the market but not later than 15 days after their availability in the market.
b)
The delivery shall be through registered/Book Post/Parcel/Courier/in person on the risk & responsibility of the firm. No postage, Insurance or any other charges whatsoever shall be paid extra. Only original Journals will be accepted and no duplicate/defective/photocopies of these shall be entertained. If any such instance comes to the notice, the same shall be returned on risk and cost of the firm. Each supplied Journals should bear the mark and stamp of the original Foreign Publisher/exclusive agent(s) in India.

The firm will supply (i) Original Electronic CD of Journals as received by them from Publishers free of cost; (ii) Subscription numbers of for all the Journals to facilitate the user; (iii) Free line services against print Journals. The Firm shall quote overall Discount percentage to be allowed on Publisher’s price list/Catalog of Medical Journals for the subscription year 2009-10 as per Annexure ‘B’
10. PERFORMANCE SECURITY (SECURITY DEPOSIT) The supplier shall furnish performance security for an amount in rupees equivalent to 5 %( five percent) of the value of the supply order in the form of a bank guarantee within 30 days of placement of the supply order as per proforma enclosed. The performance security will be discharged/ returned within 30 days of completion of the supply order. No interest is payable on the security deposit. 11. PENALTY CLAUSE:(a) For delays-if the supplier fails to supply books, & journals as per purchase order within the time period specified in the contract, the purchaser shall deduct from contract price a sum equivalent to 0.5 percent of the price of delayed items for each week of delay or part thereof until actual delivery up to a maximum of 10 (ten) percent. Once the maximum reached, the purchaser may consider termination of the contract. (b) Termination for default: - The purchaser may, without prejudice to any other remedy or breach of contract, by written notice of default sent to the supplier, terminate the contract in whole or part if the supplier fails to deliver any or all publications ordered to him within the time period specified in the contract, or if the supplier fails to perform other obligation(s) under the contract. In the event of the termination of the contract by ESI Hospital in whole or in part, the hospital may procure, upon such terms and in such manner as it deems appropriate the undelivered books, Medical Journals & periodicals and the supplier shall be liable to pay for any excess costs for such purchases. However, the supplier shall continue performance of the contract to the extent not terminated. ( c) Force majeure - The supplier shall not be liable for (a) and (b) above, if its delay in performance or other failure to perform its obligations under the contract is the result of an event of force majeure(means an event beyond the control of the supplier and not involving the supplier’s fault or negligence and not foreseeable). Such events may include, but are not restricted to, acts of the purchaser either in its sovereign or contractual capacity, wars or revolutions, fires, floods, epidemics, quarantine restrictions and freight embargo. The supplier shall promptly notify the purchaser in writing of such conditions and the causes thereof. 12. INSPECTION Medical Books, Medical Journals & Periodicals will be accepted only after the inspection by the Medical Superintendent or any officer authorized by him. Tenderers are required to comply with the above requirements and submit their tender complete in all respects and submit following documents along with the tender by the due date and time in sealed cover super-scribing “Tender For Supply Of Medical Books ,Medical Journals and Periodicals:i)

13.
No tender may be withdrawn in the interval between the deadline for submission of tenders and the expiry of the period of tender validity. Withdrawal of a tender during the interval may result in the tenderer’s forfeiture of its Earnest Money Deposit.

The successful tenderer shall not in any case sublet the contract in full or any part of it to third party
15. Tenders not meeting any/ all of the aforesaid requirement(s) shall be rejected. 16.
Conditional tenders are liable to be out-rightly rejected.
17. The Medical Superintendent reserves the right to accept or reject any tender and to the annul tendering process and reject any or all tenders at any time prior to award of the contract, without thereby incurring any liability to the affected tenderers or tenderers or any obligations to inform the affected tenderers or tenderers of the grounds for the purchaser’s action. 18. RESOLUTION OF DISPUTES
In case of a dispute or difference arising between supplier and purchaser relating to any matter arising out of or connected with the contract, such dispute or difference shall be referred to the Sole Arbitrator duly appointed by the Director General, ESI Corporation, Head quarters’ office, CIG New Delhi-110002. The award of the arbitrator shall be final and binding to the parties concerned.
